Preamble

SMCG is a simplified joint-stock company with capital of 40,000 euros whose registered office is located at 231 rue Saint Honoré 75001 Paris, registered under number 898026018 (hereinafter, “SMCG”). These general conditions of sale (hereinafter, "GTC") are intended to define the rules applicable in the context of the sale of products of the Petites Reines brand (hereinafter, the "Products") on the website www. .petitesreines.com (hereinafter, the “Site”).

ARTICLE 1: OBJECT

These T&Cs apply between SMCG and any natural person of legal age, having the status of consumer as defined in the introductory article of the Consumer Code and making a purchase on the Site (hereinafter, the "Customer"). The GCS define the rights and obligations of the parties in connection with the sale of the Products and the use of the Site and in particular the customer account. The creation of the customer account is reserved for all natural persons and aged under 18.
These T&Cs are available in French and English. It is expressly agreed that only the French version will prevail in the event that the GCS should be interpreted.


The validation of any order of Products on the Site implies the prior and express acceptance of the GCS in force.

The T&Cs are accessible at any time on the Site.

SMCG reserves the right to modify the T&Cs at any time by publishing a new version on the Site. In the event of modification of the GCS, SMCG will inform the Customers via the email communicated by the latter when creating their customer account. In all cases, the applicable GCS are those in force on the date the order is placed by the Customer. The new T&Cs will apply only to sales made after said modification. If the Customer refuses these modifications, he renounces any purchase of Products on the Site.


SMCG strives to ensure, to the best of its ability, the accuracy and updating of the information disseminated on the Site, and reserves the right to correct the content of the Site at any time and without notice.

ARTICLE 2 – PRODUCTS AND AVAILABILITY

The Products offered for sale by SMCG are those appearing on the Site on the day of its consultation by the Customer.

Each Product will be the subject of a descriptive sheet which, in addition to the photograph, will contain: the price, the sizes (if applicable) and colors available, the composition, as well as any special characteristics.

It is possible that differences between a product and its photograph exist depending in particular on the resolution and the definition of the colors of the user's screen. The photographs of products present on the site are therefore in no way contractual.

Products subject to delivery are offered for sale within the limits of available stocks.

SMCG undertakes to inform Customers as soon as possible of the unavailability of a Product. In this event and unless otherwise specified, the order will be shipped as soon as the Product becomes available or will be refunded within thirty (30) days following the cancellation of the order.

ARTICLE 3 – CUSTOMER ACCOUNT

The Customer must create an account on the Site in order to place an order. The Customer must create a secure password and provide information such as his name, first name, telephone number, email address and postal address.

The username and password are personal and the Customer expressly agrees not to disclose them to any third party whatsoever.

All Clients guarantee the sincerity, truthfulness and accuracy of the information they provide on the Site.

Registration on the Site is reserved for adults.

ARTICLE 4 – PRICE

The prices are indicated in euros (€) all taxes included (TTC), including VAT. The VAT rate is that in force on the day of the order and applicable for all deliveries within the European Union.

Preparation and delivery charges apply and vary by country. They are likely to vary depending on the size, the weight of the package, the choice of carrier and the delivery address. The fixed amount of participation in the costs of preparation and delivery is communicated to the Customer on the correct summary of the order, and this, before validation of the latter.

The prices displayed for the Products are exclusive of customs duties and/or local taxes, where applicable, in force within the State of the delivery address. In the event of delivery outside the European Union, certain States may apply customs duties, import taxes or others, the payment of which is the sole responsibility of the Customer.

Any order implies acceptance of the prices. At any time, SMCG reserves the right to modify the prices of the Products, it being understood that the price actually invoiced will be that in force on the day of the order on the Site.

Thus, the Products will be invoiced on the basis of the prices in force at the time of registration of the order, unless there is an obvious error.

ARTICLE 5 – ORDERING AND PAYMENT OF PRODUCTS

5.1 Ordering

The Customer materializes his order by completing the following 5 steps.

Step 1 : the Customer selects the chosen Products and adds them to his basket after having selected the desired options.

The basket located at the top right of the screen informs the Customer that he has taken the selections into account by indicating the number of Products it contains.

2nd step : the Customer checks the contents of his basket by clicking on "order" or "pre-order" in order to have access to the summary of his order. The Customer can then modify his order (Product, quantity, options).

The total amount including VAT of the order, distinguishing on the one hand the price due for the Products, and on the other hand the delivery costs, is then indicated in the summary.

Step 3: Once the order has been verified and, if necessary, modified, the Customer validates his basket in order to finalize his order by clicking again on “order” or “pre-order”.

If the Customer has an advantage code, reserved for the best Customers, he must enter it in the space provided for this purpose in order to benefit from it.

Step 4 : Entry by the Customer of the delivery and billing details

Fields marked with an asterisk (*) are required fields; it being specified that unless otherwise specified by the Customer, the billing address will automatically be the same as the delivery address. He is then offered to create a customer account, without which the order cannot be finalized.

If the Customer has already placed an order on the Site, he has a customer account. In such a case, he will only identify himself with his email address and password.

The Customer then verifies all the information and clicks on “validate” to continue with his order.

Step 5 : Enter bank details

The Customer will then access the secure payment screen as specified in article 5.3 below.

Payment is made online by credit card or PayPal or Alma.

The Customer must enter his bank card number, its expiry date as well as the 3 or 4 numbers of the visual cryptogram present on the back of his card.

If the payment is accepted, the Customer will be redirected to an order confirmation screen on the Site.

In the event of payment failure, the Customer will have up to 3 attempts to re-enter their bank details. At the end of the 3rd refusal, the Customer will be redirected to a screen indicating the refusal of payment. 5.2 Order Confirmation

Upon acceptance of the Customer's payment, the Customer will receive an order confirmation email summarizing all the items ordered, the billing and delivery address and the delivery date. This letter will be accompanied by these T&Cs in PDF format.

The Customer who has placed an order will be able to print his invoice by connecting to the Site in the “order tracking” space provided for this purpose.

SMCG reserves the right not to validate the order in the event of:

  • Obvious pricing error;
  • Unusual operation of the Customer's account (abnormal or abusive complaints, abnormal or abusive exchanges and returns, etc.);
  • Abnormal orders with regard to the quantities ordered;
  • Existing dispute(s) with the customer.

5.3 Payment

The price of the Products purchased is payable in cash, in full on the day the order is placed by the Customer.

Transactions carried out on the Site are secured by the SMCG payment system.

All information exchanged to process the payment is encrypted using the SSL (Secure Socket Layer) protocol. This data cannot be detected, intercepted or used by third parties. At no time does the Client's financial data pass through SMCG's computer system.

SMCG verifies that the connection with the Client's browser is secure before sending the payment form to the banking institution that performs the financial transaction.

As Shopify is a technical service provider, it does not handle disputes related to orders, which are handled directly by Petites Reines (SMCG) customer service as specified above, or, where applicable, by the Customer's bank.

The request for authorization to debit the card is made at the time of validation of the order on the Site, except in the event of unavailability of the servers. Shopify reserves the right to proceed with a new direct debit authorization request in the event that the first could not be completed due to the unavailability of the servers.

In the event of a payment default, an incorrect address or any other problem on the Customer's account, SMCG reserves the right to block the Customer's order until the problem is resolved.

5.4 Archiving of the order

The order confirmation is recorded in SMCG's registers, which are themselves kept on a reliable and durable medium. The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.

 

ARTICLE 6 - DELIVERY

SMCG will deliver orders accompanied by a delivery note within a maximum of ten (10) working days for delivery to Metropolitan France, and twenty (20) working days for delivery outside Metropolitan France, to from the day following payment of the order.

The invoice can still be downloaded by the Customer at any time in the "my orders" space of his account.

Any order placed on the Site from Monday to Thursday before 2 p.m. will be processed the same day; after 2 p.m., it will be processed the following day. Any order placed on Friday after 11 a.m., on Saturday and Sunday will be processed the following Monday; it being specified that orders placed on a public holiday will be processed the following working day.

At any time, before delivery of the order, the Customer may request the cancellation of the sale, in the "my orders" space of his account, and thus obtain reimbursement of the sums paid during the sale. If the request for cancellation of the sale should be made after dispatch of the order, but before delivery, the Customer must return the order in accordance with Article 6 and Article 7.

The transfer of risks, loss and deterioration of the Products, will be carried out after delivery and receipt of the Products by the Customer.

In the event of non-receipt of the parcel, the Customer may submit his complaint at the end of a period of thirty (30) days after the formalization of the order.

SMCG undertakes to return the Products purchased at its expense within 2 weeks for mainland France and 3 weeks for any other destination from the date of the complaint and after confirmation by the carrier that the package has been lost.

If delivery has still not taken place after this new deadline, the Customer may cancel the order by registered letter with acknowledgment of receipt. SMCG will fully refund the sums paid by the Customer within fourteen (14) days of receipt of the order cancellation request.

ARTICLE 7 – RETURN OF PRODUCTS

The Customer is required to check the conformity of the Products received in execution of his order at the time of delivery. Any anomaly concerning the delivery such as:

• Damaged package;
• Missing products;
• Deteriorated products;

• Products not conforming to the order must be notified within fourteen (14) days of receipt of the order.

In order to return the Product(s) for which an anomaly has been noted, the Customer must comply with the following procedure:
• Fill in the delivery note attached to the package in the boxes provided for this purpose as well as the reason for the return and the quantities returned;
• Properly pack the Product(s) to be returned and enclose the duly completed Delivery Note. The package should be returned to the following address:

Upon receipt of the Product(s) and effective observation of their non-compliance, SMCG offers the Customer either:
• the replacement of the Product(s) at SMCG's expense;
• reimbursement of the price of the order (price of the Products and delivery costs) as well as the costs of returning the non-compliant Product, at the latest within thirty (30) days from the date of dispatch of the notification confirmation of non-compliance by the Site's Customer Service.

In the event of reimbursement, SMCG reimburses all of the Products returned for non-compliance as well as the shipping costs incurred, with the exception of taxes and customs duties paid by the Customer upon delivery.

In the event of abnormal or abusive complaints, SMCG may refuse to serve a subsequent order.

ARTICLE 8 - RIGHT OF WITHDRAWAL

The Customer has a period of fourteen (14) days from the date of receipt of his order to return the Products ordered, without justification or penalty.

For any return under the right of withdrawal, the procedure below must be fully respected:

The products must be returned in their original packaging, with their label and any accessories in their original condition.

Subject to the conditions mentioned above, SMCG will reimburse the amount including VAT of the order to the Customer (price of the Product and delivery costs) no later than fourteen (14) days following the date on which SMCG receives notification of the request. of withdrawal. For this reimbursement, SMCG will use the same means of payment as that used by the Customer during the initial purchase.

After the withdrawal period of fourteen (14) days from the order, the Customer can no longer withdraw.

ARTICLE 9 – LEGAL GUARANTEES

The Products offered comply with the French legislation in force. All Products benefit from the legal regime of the guarantee of conformity provided for in articles L217-4 and following of the Consumer Code, as well as the guarantee against hidden defects of articles 1641 and following of the Civil Code.

It is recalled that within the framework of the legal guarantee of conformity intended for consumers, the Customer has a period of two (2) years from the delivery of the Products to act. He can choose between repair or replacement subject to the cost conditions provided for in article L.217-9 of the Consumer Code.

It is exempted from providing proof of the existence of the lack of conformity of the Products, at the time of delivery during the 24 months following the delivery of the Products.

This guarantee applies independently of any commercial guarantee.

The Customer may decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the Civil Code and can then choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code.

ARTICLE 10 - PERSONAL DATA

As part of these T&Cs, SMCG is required to collect Customers' personal data for the following purposes:
• Order processing;
• The communication to the Client of information on the Petites Reines brand;
• The communication to the Client of information on the Site;
• To make him benefit from commercial offers if the Customer accepts it expressly by validating his order.

The information strictly necessary for SMCG in the context of the management of the Customer's order is indicated by an asterisk (*).

All personal data collected by SMCG is treated with the strictest confidentiality and transparency, in accordance with national laws and applicable European regulations.

Within the framework of the aforementioned purposes, the Customer's data is intended for SMCG staff and may be transmitted to service providers or partners located within the European Union for the purpose of performing additional services, such as the payment service. and delivery. All data controllers and subcontractors undertake to comply with these rules. Depending on the choices made by the Customer when collecting his personal data, he may receive offers from SMCG partners.

The Customer can also delete or rectify his personal information himself from his Customer space by identifying himself using his email address and password.

The Customer's personal data is kept for a period strictly proportional to the purpose of its collection. Thus, the data is kept for the entire duration of the contractual relationship between SMCG and the Customer and up to three (3) years after the end of it. At the end of this period, SMCG may ask the Customer if he wishes to continue to receive information from SMCG. In the absence of positive and explicit action on the part of the Customer, the data is archived for the duration of the legal prescription as well as for a period of ten (10) years from the end of the accounting year of the year of the end of the contractual relationship for the purposes of invoicing and accounting management.

SMCG undertakes to take all necessary precautions to ensure the security of its files and the protection of its computer system, and in particular to prevent the Customer's personal information from being distorted, damaged or accessed by unauthorized third parties.


The Customer's personal information is sent to and stored at the site host located in France, whose contact details appear on the Site under the heading “Legal Notices”.

In accordance with the legal and regulatory provisions, the Customer has a right of access, rectification, portability, deletion, limitation of the processing of his personal data, opposition as well as the right to define directives after his dead.

ARTICLE 12 - INTELLECTUAL PROPERTY

Use of the Site is reserved for strictly personal use. ARTICLE 13 - LIMITATION OF LIABILITY

ARTICLE 14 - FORCE MAJEURE

SMCG will not be liable for the total or partial non-performance of its obligations under the order placed by the Customer, if this non-performance is caused by an event constituting a case of force majeure as defined by law. positive.
In such a case, SMCG will inform the Customer of the occurrence of such an event within 3 (three) clear days following its occurrence, by e-mail.
After a period of 1 (one) month, and in the event that the event constituting a case of force majeure persists, the order will be canceled and will, if necessary, be reimbursed by SMCG on the credit card used to place the order within a maximum period of 30 (thirty) days.

ARTICLE 15 - DISPUTES

The parties agree that they will attempt in good faith to settle any dispute or claim related to these T&Cs amicably.

Failing this, the Customer may contact the mediation service of the Federation of e-commerce and distance selling (FEVAD) by post to the address Service de mediation du e-commerce de la FEVAD, 60 rue la Boétie , 75008 Paris, relationconso@fevad.com or via the online form available on the website https://www.mediateurfevad.fr/.

Recourse to the ombudsman is free. After being seized of the dispute, the mediator collects the information he needs to investigate the case and issues an opinion within three (3) months.

This notice is not binding on either SMCG or the Client, who retain the right to take legal action.

In the event of failure of amicable settlement and failure of mediation, any claim, dispute or dispute in connection with these GCS is subject to the jurisdiction of the defendant's place of residence.

ARTICLE 16 – APPLICABLE LAW

These T&Cs are executed and interpreted in accordance with French law.

ARTICLE 17 – INTERPRETATION

In the event of a conflict between these T&Cs and any other document, these T&Cs prevail.

In the event that one of the provisions of these GCS is declared null or inapplicable, the other provisions are not affected and produce their full effects.

These T&Cs constitute the entire agreement concluded between the Customer and SMCG regarding the sale of the Products via the Site, and replace any prior agreement where applicable.

The fact that SMCG does not exercise its rights arising from these GCS does not in any way constitute a waiver or loss of these rights.

ARTICLE 18 - DURATION

These conditions apply throughout the duration of the online publication of the Products offered for sale by SMCG.

ARTICLE 19 - PROOF

The computerized registers kept in the information systems of SMCG and its partners under reasonable conditions of security, will be considered as proof of communication, orders and payments made between SMCG and the Customer.
